Annual Meeting

Minutes

The North Dakota Powersports Dealers Association held its annual meeting on November 8, 2006 at 10:00 a.m. at the Comfort Inn in Bismarck, ND.

Present:  President Justin Bohn - Cycle Hutt, Executive Director Keri Wanner, Bob Nyseen – Ma’s Cycle, Keith Simonieg – Queen City Motors Honda West, Jeremy Berg– Pure Honda, Keith Braunberger - Pure Honda, and Jeremy Henizenga – Full Throttle Motorsports.

Others Present:  Arik Spencer – North Dakota Parks & Recreation and Lee Klapprodt

President Justin Bohn called the meeting to order at 10:25 a.m. 

The meeting agenda was reviewed and approved as mailed. 

The financial reports were reviewed and approved.

Discussion was held on the bylaws.  A suggestion was made to change the bylaws from a 501 (c) 3 organization to a 501 (c) 4 organization which represents social welfare groups.  Organizations that are 501 (c) 4’s can lobby and it was felt this is necessary to secure possible riding areas.  The bylaws members section needs to be updated to state the members are the licensed powersports dealers in the state.  The director listings should represent the licensed businesses instead of specific person.  Keith Simonieg from Queen City Motors Honda West made a motion to have four directors, one from each region representing the organization.  He amended his motion to have six directors. Bob from Ma’s Cycle seconded the motion – motion carried.  At this time suggestions for possible directors included Arnie’s Motorcycle Sales from Williston and Pure Honda from Minot representing the Northwest Region, Revolutions Powersports from Grand Forks representing the Northeast Region, Queen City Motors Honda West from Dickinson and Full Throttle Motorsports from Bismarck representing the Southwest Region, and Ma’s Cycle from Fargo representing the Southeast Region.  A suggestion was made to describe the two different types of memberships in more detail.  Keri will make changes to the bylaws addressing the above suggestions and provide them before the next meeting. 

Discussion was held on possible legislation for the 2007 Legislation session.  Justin Bohn from Cycle Hutt would like to see the Dealers association pursue franchise laws to protect North Dakota’s powersports dealers.  Discussion was also held on age rating the cc’s on OHV’s.  Bob Nyseen from Ma’s Cycle would like to see three different classes of scooters:  first class up to 49 cc’s, second class up to 250 cc’s, and third class anything bigger than 250 cc’s.  More information will be developed for discussion at the next meeting.

Arik Spencer, North Dakota Parks & Recreation Division Manager, reviewed things they are working on effecting motorized recreation.  He spoke about the out-of-state snowmobile pass.  The pass sells for $15 and the law stipulates that all of the proceeds be placed into the snowmobile trail fund.  In the 2007 Legislative Session the North Dakota Parks & Recreations is pursuing a bill that will allow sellers to take a $1 of the proceeds as an incentive to sell the passes.  He also took the time to answer questions.

Keri spoke with the President of the North Dakota Dirt Riders Jason Lueder.  Jason stated the organization has approximately 175 members and is working with the North Dakota Parks & Recreation Department.  They are also working on trying to secure an alternate ORV area on the core land in place of the section which was lost near Garrison Dam in the late spring of 2006.  

Snowmobile North Dakota has a couple new items this year.  First the organization switched the Sno-Dak News from a newspaper to a magazine.  Second, the company had promotional folders developed to provide to people interested in snowmobiling in North Dakota.

Keith Simonieg from Queen City Motors Honda West motioned to adjourn the meeting, Jeremy Henizenga from Full Throttle Motorsports seconded the motion – motion carried. 

Justin Bohn from Cycle Hutt nominated Jeremy Henizenga from Full Throttle Motorsports and Jeremy Berg from Pure Honda seconded the motion.  Jeremy Henizenga from Full Throttle Motorsports declined the position so the motion was not carried.  All officer and director elections will be tabled till the next meeting. 

The next meeting will be Wednesday, December 13th, 2006 at 10:00 a.m.  The focus of the meeting will be membership, approve the bylaws, and to finish officer and director elections.
