2009 Potential Motorized Legislation

Motorized Recreation Dealer Legislation:
$5 Safety Fee:  Currently the Safety Fee is implemented for OHV’s and is collected when dealers sell OHV’s.  The revenue generated from the fee is used to administer the motorized safety education program.  This legislation would require dealers collect a $5 safety fee on all snowmobile sales as well, to provide additional funding for administration of the motorized safety education program.  This legislation will also include a penalty for dealers that do not comply in collecting these fees and submitting the revenue to North Dakota Parks and Recreation on a quarterly basis.     Failure to comply means the loss of the dealers North Dakota Motor Powered Recreational Vehicle Dealers license.  

OHV Legislation:
 Increase in OHV Fines:  The fines within the OHV section of the North Dakota Century Code (NDCC) have not been updated since 1993.  A $50 increase for failure to register and a $15-$30 increase for other violations has been presented.  Honorable Senators Gary Lee and Judy Lee or Sponsoring and Co-Sponsoring the legislation.

2.      OHV Registration Increase:  NDORVA is perusing a $10.00 increase in the OHV trail tax portion of the registration fee. The effect would be a 3 fold increase in the amount of funds going into the OHV trail fund or from $130,000 in biennial revenue to $400,000 in revenue projected for the 2009 – 2011 biennium. In anticipation of this potential increase NDPRD has examined how these funds could be used and would develop a local government/club grant program with 40% of the funds to assist with local trail development. An additional 40% would be used to assist the NDPRD with major project development, 10% for law enforcement grants to counties and the final 10% for safety education.

Snowmobile Legislation:
Increase in Snowmobile Fines:
  The fines within the snowmobile section of the North Dakota Century Code (NDCC) have not been updated since 1993 with the exception of the $100 fine for operation of a snowmobile within the parallel boundaries of an interstate right-of-way (39-24-09).  For snowmobiles, we are looking at a $50 increase for failure to register, a $100 increase for failure to obtain liability insurance when operating on a state snowmobile trail, a $100 increase for operation of a snowmobile within the parallel boundaries of an interstate right-of-way, and a $30-$40 increase to all remaining fines outlined in the snowmobile section of the NDCC.  Honorable Senators Gary Lee and Judy Lee or Sponsoring and Co-Sponsoring the legislation.

2.     Snowmobile Right-of-way (ditch) operation at night:  Honorable Representative John Nelson is sponsoring a bill to place an exception in the snowmobile section of the ND Century Code (NDCC) allowing snowmobile traffic to travel against traffic when on a designated state snowmobile trail.

3.     Liability Insurance:  Currently, snowmobiles are only required to carry liability insurance when operating on a state snowmobile trail.  This legislation would require liability insurance when operating on all public property.  A bill sponsor hasn’t been found as of this time.
